Building a custom home is one of the largest investments you'll ever make. So before you fall in love with a floor plan or a finish, it's worth asking a much less glamorous but far more important question: Is your builder licensed and warrantied?
In Ontario, two names tell you the answer: Tarion and the HCRA. These organizations form the backbone of new-home consumer protection in Ontario.
It’s important to know what they are, why they matter, and what it means to build with a company that is HCRA-licensed and enrolls its new homes with Tarion, so we’ve provided the information you need below.
Tarion and the HCRA: Who Does What?
For many years, these two organizations sat under one roof. Today they're separate, and understanding the split makes the protection you receive much clearer.
The HCRA (Home Construction Regulatory Authority) is the body that licenses and regulates the people and companies who build and sell new homes in Ontario. Before a builder is granted a licence, the HCRA assesses their conduct, technical competence, and financial capacity to actually run a homebuilding operation. In Ontario, it is illegal to build or sell a new home without a valid HCRA licence — so a builder's licensed status is your first, most basic assurance that they meet the province's professional standards.
Tarion administers Ontario's new home warranty and protection program. The warranty itself is provided by your builder and backstopped by Tarion — meaning if a covered issue isn't resolved by the builder, you can bring a claim to Tarion directly. This is the safety net that protects your deposit, your closing dates, and the quality of the home long after you've moved in.
At a high level, the HCRA (Home Construction Regulatory Authority) vets and licenses the builder; Tarion protects the buyer. A trusted Ontario builder works within both systems.
Why an HCRA Licence Protects You Before Construction Even Begins
The HCRA license is an ongoing commitment to professional standards for honesty, integrity, competence, and conduct. The HCRA can take action against, or even revoke the licence of builders who don't meet those standards.
Choosing a licensed builder means choosing someone who has been formally assessed and is publicly accountable.
What Tarion Warranty Coverage Means For Your Home
Tarion protection follows your home through two phases.
Phase 1: Before you take possession, your warranty includes financial protection such as deposit coverage and compensation if your closing or occupancy is delayed beyond the agreed timelines. These protections matter most in exactly the situations no one plans for.
Phase 2: After you take possession, the statutory warranty is divided into three coverage periods, each protecting against specific items:
One year: coverage for defects in work and materials, unauthorized substitutions, and certain Ontario Building Code-related items.
Two years: coverage for specific systems, including water penetration, electrical, plumbing and heating delivery, and certain other defects.
Seven years: coverage for major structural defects.
Something to remember is that coverage stays with the home for up to seven years even if you sell it. Its protection is attached to the house, not just to the original purchaser, which can also be a selling point down the road.
Good To Know In 2026
As of April 1, 2026, purchasers of new freehold homes are expected to register their purchase with Tarion within 45 days of signing an agreement of purchase and sale. Registration is free and is intended to help purchasers qualify for the maximum deposit protection available under the program. Tarion has also announced a transition period, with related deposit-coverage changes deferred until January 1, 2027.
